Article summary

Abstract

The development of criminal law in India can be traced back to the history of evolution
of law proper which started with the emergence and growth of king as a symbol of justice.
In the earliest Dharmashastras there is a reference that the administration of justice
was firmly established as an important function of the king. The king was looked upon
as a beholder of social and moral order and for the purpose of maintaining Dharma, he
was endowed with the power of Danda, i. e. the punishment. The duty of the king was
to maintain and uphold the law.
